Erm, I think the regs apply to superior/subordinate relationships. Sam/Kara is two Lieutenants. There was a line, somewhere (I think the deleted scene with Cally) about how Boomer signs off on their pay stubs and promotions and reviews and crap.
However, this does make Lee/Kara completely impossible, canon-wise. ;)
